I had only applied to the school mentioned above. So I am not waiting to hear from any other schools. I am only waiting to hear from UPenn about its wait list.

I hope and pray that you may get call from Upenn. AS i have claculated from LL.M Guide posts, a good number of admitted students at upenn will be joining to CLS and some other scholls. So i positively guess you have fair chance. AS I have come to know that they do not base their decisons from country to country. I hope to see you at Upenn.

See as far as I know from whatever information I have gathered from various sources that they usually send offers to more people than the number of seats available at their program which means they anticipate that about 15 to 20% of the people will decline their offer and choose a different school and accordingly they release more number of acceptances. Now if in case there is a shortfall amongst these candidates from the extended pool of accepted students, they generally fall back to their wait list.
Officially they do not declare how they select students from the wait list but unofficially it has been said that to maintain diversity they would firstly look at the geographical/regional/country specific representation and in case of one's shortfall, the university shall attempt to fulfill the same with another candidate who comes from such region/country.
Keeping this in mind the hypothesis that one can formulate is that if two Germans have declined their offer, they will attempt to fill the vacant seat by admitting another German.
If in case, no other German is available, they will look to a random candidate or other suitable candidate that promotes the diverse mix of experience and fulfills their need of regional diversity.
Usually in the posts from the last 3 to 4 years on LLM guide, I have seen that they have selected very few candidates from the wait list and no more than 4 or 5 candidates.
This is the only reason why they do not provide a candidate with his relative position on the wait list.
