Getting a waiver from the 3 years admission rules

I have passed the New York Bar exam in July 2007 and was intimated about the same in November, 2007. Unfortunately as I was on a student visa and later on OPT, I had to go back to India, as I was not successful in getting a job in the U.S. I am working in India in the Legal Dept, for a reputed MNC. I did not do the necessary paperwork to get admitted to the New York Bar.

I am now interested to get myself admiited to the New York Bar, however, it is more than 3 years, since I have been initimated about passing the exam, as per the rules I may not be eligible to get admitted. However I heard that you can get the waiver, by appealing to the NY Court of appeals.

My query is how easy is it to get the waiver and am I personally required to be present in NY to file the petition ?

Is generally such a waiver granted ?

It is critical for me to get admitted, to NY Bar as i will back to U.S. on a green card and need to look for a job. I don't want to rewrite the exam, as I don't have the time and patience to go through it, once again. Had slogged hard to clear the exam !

Any helpful advice on this would be highly appreciated.
