The Covid pandemic has highlighted and exacerbated inequalities in work. While some worked remotely, others especially poorly paid workers of color had no choice but to work in person or to lose their job. Yet the Supreme Court declared it to be beyond OSHA’s power to mandate employer efforts to slow the spread of disease. Although the conservative Court majority has launched an assault on workers’ rights and civil rights, in California and many other states, innovative legal approaches are flourishing in ways that build worker power across divides of race, class, and other lines of division. In the 17th annual lecture in honor of the civil and labor rights lawyer-activist Jack Pemberton, Professor Fisk explores the hopes for workplace justice in challenging times.
