The Program
Two fundamental courses. The two core courses (International Arbitration I & II) form the foundation of the LL.M. AWArDS. Delivered throughout the two semesters, this fundamental teaching, with a total volume of 60 hours, will combine a global theoretical approach to international arbitration, both commercial and investment treaty based, with the deepening of these main central themes. From the agreement of the parties to resort to arbitration to the enforcement of the award, from the determination of the applicable law to a detailed examination of procedural intricacies, the fundamental courses will enable students to acquire a comprehensive understanding of the essence and functioning of international arbitration.
Twelve specialization courses. The 12 specialization courses will enable students to acquire a detailed understanding of the various types of disputes arising in main sectors of activity, as well as the knowledge necessary for their settlement through arbitration or, where appropriate, through international litigation. Those courses will also offer an opportunity to focus on certain core issues from a procedural point of view in international arbitration or investment proceedings (evidence, complex proceedings, etc.). These specializations courses are based on a more practical approach in order to examine the methods, sources and main difficulties encountered in the field.
Six optional courses. The six optional courses will provide an in-depth dive into the role of international commercial arbitration and investment arbitration in the settlement of international disputes. The courses will put into perspective the tools or central issues of international arbitration, through a comparative approach, for example concerning the arbitration agreement, the determination of the law applicable to international contracts or the enforcement of arbitral awards. The contextualization of arbitration will also be achieved through an thorough study of the use of alternative solutions: international business litigation, transactional agreements through assisted negotiation processes (mediation, conciliation, etc.) between the parties. Finally, the substantial protection of foreign investments will be envisaged in particular through the evolution of the protection regime in relation to the steps taken by the European Union and its Member States.
Twelve workshops. To be able to make a useful contribution to the settlement of international disputes through arbitration in commercial or foreign investment matters, students must also be confronted with the realities of a demanding practice. A comprehensive and detailed understanding of arbitration, its intricacies and applicable legal regimes is not enough. Students must be faced with its practical implementation, in a way as close as possible to actual practice.
Such is the objective of the series of ten workshops throughout the year. These will involve practitioners, both academic and non-academic, who will expose students to the necessary practical skills and knowledge. These workshops will highlight the importance of provisional and conservatory measures, the art of conducting and arbitral proceedings, including an expedited one, as well as the art of persuading (both in writing and orally) or to the art of examination and cross-examination. They will discuss in detail the distinctive features of some of the main arbitration rules and centers. A workshop will also be devoted to the delicate issue of damage assessment in international arbitration, which requires economic, financial as well as legal expertise. To keep up with a fast-changing technological environment, artificial intelligence will also be addressed.
